Injunctions

Injunctions, sometimes referred to as restraining orders, are actions brought by a party asking the Court to direct the opposing party to have no contact with him or her.  Most commonly these are brought as Petitions for Injunction for Protection Against Repeat Violence or as Petitions for Injunction for Protection Against Domestic Violence.

Petitions for Injunctions for Protection Against Repeat Violence are governed by Florida Statute 784.046.  For the Court to grant these petitions, certain statutory criteria must be met.  Most importantly, there must be more than one instance of violence, or threat of violence, and/or the Petitioner must reasonably believe that violence is imminent.

Petitions for Injunctions Against Domestic Violence are governed by Florida Statute 741.30.  Again, certain statutory criteria must be met and the Petitioner must reasonably believe domestic violence is imminent.
